The force continuum in Texas allows police officers to ALWAYS have a position above the individual, so that the officer is not at a disadvantage. The problem comes when, officers abuse that advantage given to them by law. In other words, when the officers abuse their discretion.
Unlike the case of Rodney King, where the media was all over because of the video, most cases in Texas do not involve a video of the incident. In fact, it has been our experience that, once an incident with force is about to occur, the cameras in the officer's vehicle are not recording. This places the individual at a disadvantage against the word and the incident report of the officer. less
